The GDPR

The General Data Protection Regulation (GDPR) is a regulation in EU law on data protection and privacy in the European Union (EU) and the European Economic Area (EEA). It also addresses the transfer of personal data outside the EU and EEA areas. It was adopted in 2016 and became enforceable in May 2018.

The GDPR establishes principles and guidelines for the collection, processing, storage, and sharing of personal information by organizations. Its primary aim is to give control to individuals over their personal data and to simplify the regulatory environment for international business by unifying the regulation within the EU.

Key principles addressed by the GDPR include:

  1. Lawfulness, fairness, and transparency: Data must be processed lawfully, fairly, and in a transparent manner in relation to the data subject.

  2. Purpose limitation: Data must be collected for specified, explicit, and legitimate purposes.

  3. Data minimization: Data collected must be adequate, relevant, and limited to what is necessary.

  4. Accuracy and Accountability: Data must be accurate and, where necessary, kept up to date, and the data controller constitutes the entity responsible for, and must be able to demonstrate compliance with, these principles.

  5. Storage limitation: Data must be kept in a form which permits identification of data subjects for no longer than is necessary.

  6. Integrity and confidentiality: Data must be processed in a manner that ensures appropriate security of the personal data.

Non-compliance with the GDPR can result in significant fines. Implementing GDPR standards reflects a commitment to the highest global standards of privacy and data protection.

The main responsibilities and duties of the DPO include: I – To inform and advise the controller and the employees who carry out processing of their obligations pursuant to the GDPR; II – To monitor compliance with the GDPR and with the policies of the controller in relation to the protection of personal data; III – To provide advice where requested as regards the data protection impact assessment and monitor its performance; IV – To cooperate with the Supervisory Authority; V – To act as the contact point for the Supervisory Authority on issues relating to processing.

All data collected by us will be deleted upon your request, through a free and streamlined procedure, or when they are no longer necessary or relevant for us to offer you our services, unless there is any other reason for their maintenance, such as a possible legal obligation of data retention or the need to preserve them to safeguard FORTRON's rights.

We observe and comply with Data Protection Regulations seriously. Therefore, FORTRON may share the collected data, with your consent, with its business partners solely for the specific purposes mentioned in item 2 of this Policy. We allow you to request a list of your consented data, including for the purposes of data portability provided for in applicable data protection regulations (such as Article 20 of the GDPR).

FORTRON reserves the right to amend this Privacy Policy and the Cookie Policy as many times as necessary, aiming to provide you with more security and convenience and to increasingly improve your experience. That is why it is very important that you access our policy periodically. If material changes are made that require new authorizations from you, we will publish a new privacy policy. The date of the last update will always be at the beginning of the document.

We take security management and compliance responsibilities very seriously. FORTRON evaluates and maintains incident plans that may involve unauthorized access to personal data. All activities described herein are foreseen and are part of the Information Security Plan (ISP) maintained by FORTRON.

This document is governed by current Brazilian legislation. The Forum of the District of Campo Mourão, State of Paraná, Brazil, is elected as the competent venue to settle any questions that may arise from this document.
